Whistleblowers Will Receive $9.67 Million From Genesis Healthcare Fraud Settlement

Genesis Healthcare, Inc. agreed to pay the federal government $53.6 million dollars ($53,639,288.04 to be exact) to resolve False Claims Act allegations. Genesis was facing four separate sets of allegations that companies and facilities acquired by them had violated the False Claims Act by submitting false claims to government health care programs, including Medicare, Medicaid, TRICARE, and Medi-Cal, for medically unnecessary treatments and hospice services, and grossly substandard and/or worthless nursing care. The settlement resolves six federal lawsuits and investigations.

Genesis acquired the company SKG and its subsidiaries after the conduct at issue occurred. The Department of Justice states: “The claims resolved by the settlement are allegations only; there has been no determination of liability.” The settlement amount was determined based on Genesis’ ability to pay.

Whistleblowers Will Receive $9.67 Million From This Settlement

The allegations against Genesis were originally brought in lawsuits filed under the Qui tam provisions of the False Claims Act. A Qui tam is a civil lawsuit brought by a “whistleblower” under the False Claims Act. A whistleblower is an employee who reports misconduct perpetrated by their employers.

The False Claims Act permits private parties to sue on behalf of the government for false claims for government funds and to receive a share of any recovery made by the government. It rewards whistleblowers if their Qui tam case is successful and recovers funds for the government.

The Whistleblowers who assisted the government are Joanne Cretney-Tsosie, Jennifer Deaton, Kimberley Green, Camaren Hampton, Teresa McAree, Terri West, and Brian Wilson, all former employees of the companies acquired by Genesis. These people will receive a combined $9.67 million as their share of the $53.6 million recovery in these cases.
