Embezzlement in Arizona

Embezzlement is the theft, misuse, or misappropriation of funds that belong to someone to whom you owe some type of duty. It requires that the person embezzling funds must have been entrusted with someone else’s money and that they had legal access to the funds. Embezzlement is considered a White Collar Crime.

The most common example is a company employee who embezzles money from his employer. Another example is a financial investment advisor who improperly uses clients funds she has been entrusted to protect.

Though, embezzlement can take many forms. It can occur when a large amount of money is taken at once, or when smaller amounts are misappropriated over a long period of time. Embezzlement schemes can be complex, and can include falsified financial records, fraudulent billing, Ponzi schemes, or other large-scale fraud schemes.

In Arizona’s criminal law statue, embezzlement is referred to simply as theft. A.R.S. §13-1802. Theft is punished according to the value of the money (or property) stolen. For example, theft of less than $1,000 in value is a class 1 misdemeanor, and can carry penalties of a fine of up to $2,500 and up to six months in jail, or both. On the other end of the scale, theft of over $25,000 in value is a class 2 felony and can carry a sentence of up to five years in prison. A.R.S. §13-1802(G).
